DENPASAR, BALINEWS — The legal team representing I Made Daging, a former head of the Bali Regional Office of the National Land Agency (BPN), plans to file a third pretrial petition challenging the termination of an earlier investigation and the revocation of his suspect status.
Gede Pasek Suardika, one of Daging’s lawyers, said the petition would seek a judicial review of the investigation termination order, which the legal team believes is inconsistent with a previous pretrial ruling issued by the Denpasar District Court.
Pasek made the statement after a pretrial hearing on the parties’ closing submissions at the Cakra courtroom of the Denpasar District Court on Monday, October 12, 2026. The ongoing case is registered under Number 16/Pid.Pra/2026/PN Denpasar, with the Bali Police’s Directorate of Special Criminal Investigation (Ditreskrimsus) named as the respondent.
“Today, we plan to file a third pretrial petition concerning the termination of the investigation and the revocation of Mr. Made Daging’s suspect status in the previous case,” Pasek said.
He explained that the legal move was intended to uphold the authority and integrity of court rulings. In his view, matters that have been addressed through pretrial proceedings should be resolved through the judicial process to ensure legal certainty for his client.
Pasek argued that terminating an investigation through a formal order known as an SP3 does not necessarily provide full legal certainty, as he believes it could leave room for further legal proceedings against Daging.
“If he is indeed entitled to be cleared, then let him be cleared by the court, rather than having things repeatedly reversed after a ruling has been issued,” he said.
Pasek stressed that his team wanted the matter to be examined and decided in court so that Daging’s legal status could ultimately obtain permanent legal certainty through a final and binding ruling.
He also described the planned petition as a legal step taken with reference to the newly enacted Criminal Procedure Code (KUHAP). He said the petition would specifically challenge the investigation termination order, which his team considers inconsistent with the earlier pretrial ruling.
In addition to pursuing pretrial proceedings, Daging’s legal team has previously filed a complaint with the Indonesian National Police’s Professional and Security Division (Propam) over alleged obstruction of a police report. The lawyers have said they intend to pursue further legal action against parties they believe are responsible.
However, the claim that the termination of the investigation conflicts with the previous pretrial ruling remains the legal team’s position. The validity of the investigators’ actions and the merits of the planned petition remain subject to examination through the applicable legal process.
